I don't know what state you reside in,here in California if served,it takes time, and there are ways to delay it,I informed a landlord a couple a months ago that I was moving out two weeks later than planned, just to be an evil b****,she served me with a three day notice, but by the time she filed it I was already gone, two weeks was just not long enough,I moved into my new house on the 12 day.The owner wasted time and $300 bucks on nothing,in the end she looked utterly stupid.
Ask God. He will fix everything.
It appears as though you haven't paid your rent in this case. In my state you give the tenant 7 days to pay up if it's over due with a 7 day notice, then if it's still not paid you give them a 7 day notice to leave the premises.

I can also figure that your lease says that the landlord has the right to do this also.

Your hands are tied, find a friend with an extra bedroom and a couch or go home to your parents. At the very worst you can find a shelter to stay in until you can come get the kids through school and come up with another deposit for another apartment.
