If his marriage to his currant wife is one that would be recognized by the United States, then yes, he will have to get a divorce from her. Or he can try not mentioning it and hope it never surfaces to bite him in the behind ;)

dang, im just gonna tell him to get a divorce, because when they came to the US, they just said they were married, they never got legal documentation here in the US stating they were married there.
Is he a US citizen now? If they came here on visa's and did not show documentation that they were married, then they must have come over as travel companions. I still wouldn't risk it. Depending on the country he was married in, he might be able to file for divorce and get one after reasonable attempts to notify his wife. I can't help without knowing the country and something of it's divorce laws.
Did they become naturalized citizens? If so, I think they would have had to show they were married. I have a feeling it's documented somewhere if they had a legal wedding in their country before coming here. I'm sure marriages in Iraq are recognized in the US. He can check with a divorce lawyer who deals with international divorces for his best steps to getting his marriage voided. Some lawyers may give a free consultation. In the Great South Land you can apply for a divorce after one year living apart, however, you must make reasonable attempts to advise your spouse and serve the divorce papers on them. Unless you both wish to be polygamists which is against the law in the USA, he needs to get a divorce in the same country he was married in. Then you two can get married.

I'd think twice. He could be hiding something. We knew a guy who came to Australia from India as a student. He was always on the lookout for someone to get married to. But guess what? He had a wife and kid in India. When the relatives found out, they were waiting to do him in.
