    Under a constitution what happenings if something is not ratificed by the members?

    Does it still stand?

     2/3 of the senate must approve, then the president ratifies it. If the president does not ratify it, then nothing changes. 

    The National Security Act was never signed into law because it it fundamentally unconstitutional. But it is still in use as an Act, that, to this day remains unchallenged as a government financed agency.
