My X-husband has had me served with a motion to vacate spousal support. He lives in Massachusetts and I live in Florida. I can not afford to hire an attorney like he has nor can i afford to fly up there to represent myself. I qualified for legal aid assistance however, the legal aid office here can not help me up there and the legal aid office up there can not help me as i do not live there. I can not afford to hire a private attorney so I have no idea what to do, I recently underwent back to back eye surgeries and i can see again after being legally blind for over ten years so I was unable to respond sooner than I had the court date is approaching April 18th 2013 and i am the defendant can i file a motion to continue until i can find representation? I was told if i do nothing i will lose automatically and i left a message with his attorney he will not cal me back.

Do you know the court that he filed the motion through? If you do, I would contact that court and explain to them just what you've type here. Find out if they can mail or fax the paperwork you need to file for an extension until you can find a way to represent yourself in an out of state court.
