I think that the state should watch carefully, and be poised to take the baby immediately if there are still issues which they feel would be risk factors to the welfare of the child. I have witnessed a woman who shared the suite in hospital with my wife when our daughter was born. She was drug dependant, and the State moved right in and took the baby into custody at birth. The mother was permitted a lawyer, and they needed to prove their case in order to get child back. I do not know how that turned out (hopefully, child did not return). The child should have more rights than the parent does to protect them first and foremost.
