1st degree is planned out (AKA premeditated) , while 2nd degree means it was not something you planned to do before the incident.
For example, if one planned to kill his or her husband and bought a gun, though out the plan, and killed him, then it would be 1st degree.
If somebody walked into a gas station and asked for the money from the register, planning to rob the store but not to kill anyone, but for whatever reason ends up purposely killing the cashier, then it would be 2nd degree.
