The double jeopardy clause applies to the trial phase of the process (you can't be tried twice for the same crime). There is nothing in the consitution that applies to sentencing once you've been convicted. The judge's action may not have been completely fair, but I don't think it's illegal. (Please note I am NOT a lawyer and this is only my educated opinion. I do have a master's in political science. However, you should consult an attorney in your jurisdiction.)

thank you so much. cause i am lost with all of this. I have done almost everything i can think of. I am on our 2nd lawyer. And it seems like after we pay them we get nothing. I mean i paid this lawyer in feb. and not once has him nor his office contacted me. And when i contact them they are waiting on the transcript. But they havent told me why we are waitning on the transcript and wait we are lookn for in the transcript. its like i paid him 1500 hundred dollars just to feel like im bothering him when i call to see if anything is happening. my husband was revoked in full 15 years for violating his probation by not finishing a drug program. But after he had been sentanced to the whole 15. he was sent out and befor they took him back to jail the called him back in took back the first sentance and revoked him for eight. im not sure if its legal or not legal. BUt either way brett was not told he could appeal it.
Wendy, this may sound heartless, but it's meant for your own good: Divorce the husband, lose the lawyer and move on with your life. You are too young to be burdened by Brett's problems. Only he can fix them... and himself, with God's help. Good luck to you!
