    is it adultry when the spouse has moved out but not legally seperated?

    No, if they are having physical relations with someone else while they are still married that is breaking the bonds of marriage and is adultery.

    Some people never get a legal separation...they eventually, just get a divorce.  If a couple has been separated for a year or two, then I believe that the marriage is over and it would not be considered adultery if one or both started a relationship with someone else.
