    I was flooded in my unit by the upstairs tenant, how can I make sure they will pay damages?

    I am asking for Landlord Tenant Information regarding an upstairs apartment leak to my unit, the lady let a sink overflow causing damage to my ceiling, walls and floors. I want to know how we can be sure she will have to pay for the damages......

    If you are in a condo complex, you may not have home insurance of your own.  File a complaint with your HOA and let them sort it out for you.

    This is a rental unit the walls and ceiling damage are between the landlord and the other tenant .You can go to small claims court  regarding damage to personnel property. If I misunderstood and somehow you own the unit the same procedure applies. Get estimate X3 take pictures lots of pictures . Determine limits of small claims court IE here it is 5,000 . Yours may be more or less. Then take all your pictures and go through the court procedure. Be prepared . If you win you still have to collect thats your responsibility . You will learn the difference between civil and criminal  real fast. Then there is the if you cant find them you cant collect. Thats the best I have in advice. Judgments worthless if you cant collect
