    how to transfer property if there was no will

    There were 5 siblings and no will. all siblings will agree to dividing the property (5 acres in rural walton county, fl). there is a judgement lein against the property, but no mortgage.

    We spoke to an attorney. This property is in Florida. The attorney said it would have to go through probate at a cost of $3,000. There is no other property or assetts in the decedant's name, and the property has little value. If all siblings agree to division of the propety, why is a probate necessary?
    You may have better luck contacting the probate court with jurisdiction over this matter.
    That is a question to ask the attorney (property lawyer)that you spoke with.
    Talk to a lawyer specializing in law in your state, before taking any action.
