is it legal for the Department of Childrens Services to hand over my 4yr old grandaughter (from her mother) to a man whose name doesn't appear of the birth certificate, refuses to sign a statutory declaration declaring his paternity and hasn't paid any maintenance for her in all the four years??

Doesn't seem right,..This man must have met all of DOCS requirements if they are going to place the child in his care.I know they do extstensive checks.Maybe his parents are going to be the sole carers and you just don't know about it.Our child welfare system here in Australia has a lot to answer for,i personally know of a lot of unfair cases.

yes it is depending on your daughters current situation. if docs are involved with your daughter and want your grandaughter out of her care well obviously the father is the next of kin and if there is no proof of a father, i hear that the maternal grandparent is the next option
